COMMENCEMENT OF WORK

ODDBERRIES agrees to provide written approval of this estimate before any work is commenced, as a letter of agreement between ODDBERRIES and YOU concerning the work outlined in the brief.

PAYMENT TERMS

YOU agree to payment of 30% fee before commencement of the job. The downpayment is non-refundable. YOU agree to pay the invoiced amount within 7 days of receipt of an invoice. If the website is hosted by ODDBERRIES on its servers, the invoiced amount may be paid within 15 days of its receipt. If, after the project has commenced, subsequent invoices are not paid within 7 days, or 15 days, depending on the type of service, a 5% fee will be charged. ODDBERRIES reserves the right to refuse completion or delivery of work until all balances are paid.

FEES FOR SERVICE

It is agreed that the fee for the service is an estimate for the work provided in this proposal. If the work undertaken exceeds the items specified in this proposal, YOU agree to pay appropriate fees for the excess work.

EXCESS WORK

This is defined as any work involving additions to the list of items in this proposal or corrections to any piece of finished artwork after approval is given by YOU. If any excess work is requested by YOU, ODDBERRIES will submit a revised estimate/proposal, and work will not resume until the same is agreed by both parties.

COPYRIGHT OF DESIGN WORK

It is agreed that YOU will have the exclusive right to retain and reproduce any artwork, information, material reports and other output which is produced from the performance of the work outlined in the brief, once delivered and full payment has been received. However, ODDBERRIES will retain the right to reproduce, publish and display any artwork in our portfolios and websites for the purposes of recognition of original artwork and promotional use.

CONFIDENTIALITY

It is agreed that YOU will have the exclusive right to retain and reproduce any artwork, information, material reports and other output which is produced from the performance of the work outlined in the brief, once delivered and full payment has been received. YOU must be sure that you have permission to use any pictures or artwork you provide ODDBERRIES. In the event that any of the pictures or artwork provided by you breaches any copyright or other legal protections, ODDBERRIES shall not be made liable of any economic or other type of compensation to its rightful owner. However, ODDBERRIES will retain the right to reproduce, publish and display any artwork in our portfolios and websites for the purposes of recognition of original artwork and promotional use. This will be done without notice by ODDBERRIES; however, ODDBERRIES is open to discussion about this.

DATA STORAGE

ODDBERRIES does not store at any time any of the data provided by any of its clients.

SERVER UPDATES

ODDBERRIES shall not be liable for any issue relating to Google Server updates/errors. If YOU have any Google Server-related issues and require ODDBERRIES for technical support, ODDBERRIES will provide it for a fee.

PRIVACY POLICY


ODDBERRIES is using Google Cloud Services with SendGrid and Unlimited web hosting to provide our services. We do not send any private information to any other third party companies. In the unlikely event that we need to send this data we will send a request to you before we do in order to get your consent.
